Something tells us that The Luzerne County DA has some suspicions That Joseph Kerekes and Joseph Kerekes’ Parents may in fact have Hired Attorney Fannick to Represent Harlow Cuadra. AND, The Luzerne County DA could only come up with the lame ass defense of filling a fucking motion and claiming it is ON BEHALF of Jospeh Kerkes as a way for the Luzerne County DA to object to a lawsuit strategy that Joseph Kerekes decided to pursue.

The DA is seeking to disqualify Attorney Fannick because they claim that Joseph Kerekes may not be able to get a fair trial because Fannick met with Kerekes some 8 times prior to Fannick agreeing to represent Harlow Cuadra.

The Kicker here is that it is Joseph Kerekes, not the DA, who gets to claim and assert conflict of interest associated with counsel (if there is one) with Fannick representing Harlow Cuadra. AND, it is Joseph Kerekes who can WAIVE HIS RIGHT TO OBJECT TO CONFLICT OF INTEREST ASSOCIATED WITH COUNSEL. So,

Even if it is in fact TRUE that there is a conflict to Kerekes with Attorney Fannick representing Harlow Cuadra, Joseph Kerekes has the legal right to WAIVE any objection to that conflict. Since Kerekes’s attorneys have not raised an objection, one must assume that Kerekes has no intentions of objecting to Fannick representing Cuadra.

Again we reference Federal Judge Kaplan in the infamous KPMG Tax Case. The Accused is the only person who can waive a conflict of interest associated with counsel, NOT THE COURT.

The only conflict of interest that The Luzerne County DA has legal standing to assert is if Attorney Fannick is somehow some co-conspirator or participant in the crime. For example, The US Attorney obtained the disqualification of attorney Bruce Cutler from Cutler representing John Gotti by claiming that Cutler was intimately involved in John Gotti’s business affairs and thus that Cutler could not be an objective “officer of the court”.

The Luzerne County DA has no standing to file any motion asserting an objection ON BEHALF of Joseph Kerekes. As should be obvious. The Luzerne County DA’s motion to disqualify Fannick on BEHALF OF Joseph Kerekes has the Luzerne County DA claiming that it is acting ON BEHALF of Joseph Kerekes …. It’s an Abbot and Costello Comedy Routine.

The fucking Prosecutors have filed a motion ON BEHALF OF THE DEFENDANT? How is THAT not a fucking conflict of interest? If The Court Allows THIS motion by Prosecutors on Behalf of Joseph Kerekes, then how many other motions can the DA file on Behalf of Joseph Kerekes? It is insane that The Fucking DA has filed a motion that it claims is on behalf of a Defendant The DA is seeking the death penalty against.

From the minute Attorney Fannick signed on as Harlow Cuadra’s Counsel, We assumed that Jospeh Kerekes and Kerekes’ parents had hired Fannick to represent Cuadra because it is in Kerekes’ interest that charges be dismissed against Cuadra PRIOR to any trial or adjudication of charges for Kerekes. As we’ve stated many times here, The Entire Bryan Kocis Murder Investigation was centered entirely on Harlow Cuadra, Joseph Kerekes appears to have merely been “in the way”. Joseph Kerekes has a legal right to pursue the lawsuit strategy of his choosing even if that lawsuit strategy involves Kerekes hiring a good lawyer for Harlow Cuadra.

Again, Federal Judge Kaplan has tied the right to a specific counsel and a specific lawsuit strategy to The Constitutional Right to Legal Counsel. In other words, Joseph Kerekes had a legal right to follow the LAWSUIT STRATEGY of hiring Attorney Fannick to represent Harlow Cuadra if in fact that is what Kerekes did.
