Wouldn’t you think that the Virginia Beach District Attorney’s Office would be smart enough to NOT openly operate a blog specifically designed to taint the jury pool for murder trials for Harlow Cuadra and Joseph Kerekes?

Wouldn’t you think that, given the case that Cuadra and Kerekes already have that their constitutional rights to legal counsel were violated by Virginia, would’t you think that The Virginia Beach District Attorney’s Office would not be talking to third partys about pending criminal proceedings against Cuadra and Kerkes?

Well,

1. Some Guy running a blog is claiming that he emailed the Virginia Beach District Attorney to ask about the “allegedly still possibly pending” RICO charges against Harlow Cuadra and Joseph Kerekes and, THIS GUY proudly published what he claims was the emailed response from the Virginia Beach DA’s Office. Is it common for District Attorneys to comment on pending criminal proceedings to any third party who emails them?

2. The same guy who claimed to have gotten an emailed response from the Virginia Beach DA about “allegedly still pending criminal RICO charges against Cuadra and Kerekes” also claims that The Virginia Beach DA’s Office gave him information about charges (or the lack of charges) pending or not pending against former boybatter “Justin” (who testified at the preliminary hearing in Luzerne County). Again, is it common for District Attorneys to comment on possible pending charges against a party to an allegedly un-involved Third Pary? When SAID PERSON again proudly disclosed on a blog that he “got it from the Virginia Beach DA” that there were no charges pending against Justin, another person on the blog disclosed that The Virginia Beach DA’s response to his inquiry was that it did not comment on pending criminal proceedings.

3. There appear to be two guys who are flooding netscape.com with links to their blog about Harlow Cuadra and Joseph Kerekes and who are voting to sink all news items we post on Netscape.com relating to the Bryan Kocis Murder Scandal ( CLICK HERE for Peter Everhard’s Participation at Netscape.com) . Why would two guys who are suppose to be unbiased reporters be trying to SINK any information about the Bryan Kocis Murder that doesn’t come from them?

It appears that two guys who appear to have insider access to the Virginia Beach DA’s Office are trying very hard to taint the available jury pool against Harlow Cuadra and Joseph Kerekes.

Is there or is there not A Federal Probe of Luzerne County Courts?

Well, the answer to the question that has to be on the minds of every Defense Attorney in Luzerne County will likely get an answer on September 5. Luzerne County Judge Ann Lokuta has been ordered to name the names of Federal Investigators she intends to call as witnesses in her misconduct hearing by September 5.

Judge Lokuta has argued that a misconduct proceeding was launched against her because she aided a Federal Probe of the Luzerne County Judiciary.

If an alleged federal probe of Luzerne County’s judiciary is the “elephant in the room” in Judge Ann Lokuta’s misconduct case, the elephant is about to be marched out onto the street for all to see, Lokuta’s prosecutor said. Times Leader

“We’ll take a look at Judge Sprague’s order today and respond,” Sinatra said. “It’s not up to me to make the investigation go away. It’s not up to me to control. I’m not a United States attorney. But it’s not going away. That is a fact of life.”

So, Let’s Summarize the Problems Facing Luzerne County and the Prosecution of Harlow Cuadra and Joseph Kerekes:

1. The Current Luzerne County DA is not going to be DA after the November elections because his term as DA expires and he is running for Judge of the Court of Common Pleas.
2. It is possible that the new Luzerne County DA could be some new to the DA’s Office and a Republican (in an office apparently full of Democrats).
3. The Victim, Bryan Kocis, has to be the most unsympathetic victim in the history of American Criminal Justice. There can not possibly be anybody in Luzerne County who will hate Harlow and Joe more than they hate the fact that A Bryan Kocis was living next door to them (shooting gay bareback videos in his basement). AND, the biggest problem of all facing Luzerne County and the prosecution of Harlow and Joe,
4. The possibility that one or more Judges of Luzerne County Court could be the subject of a Federal Criminal Proceeding.

We pointed out some time ago that The Black’s Beach Tapes of Harlow Cuadra, Joseph Kerekes, Grant Roy and Sean Lockhart were proving to be more problem than benefit to Luzerne County Prosecutors. (see Harlow Cuadra Joseph Kerekes & Separate Trials)

If the Black’s Beach Tapes are admitted into Evidence against Cuadra and Kerekes by The State, based on the apparent case law of The State vs Weakley and Selenski in Luzerne County, Joseph Kerekes would have a stronger case for separating his Trial from Harlow Cuadra’s trial (because, according to The State, Cuadra incriminates Kerekes on The Black’s Beach Tapes).

Not only would separate trials for Cuadra and Kerekes be more expensive but, since certain evidence could not be submitted against Harlow unless Joe testifies against Harlow at Harlow’s Trial (and vice versa, certain evidene against Joe could not be submitted unless Harlow testifies against Joe at Joe’s trial), it seems it would be “more difficult” (to say the least) to convict either Cuadra or Kerekes before an impartial judge and jury if there are separate trials.

It is important to keep referencing the point “impartial judge and jury” because, without an impartial judge and jury, as Marsha Clark and Thomas Sneedon prove, an idiot prosecutor can convict anyone of anything. AND, what goes farthest in guaranteeing an impartial judge and jury is “to have the whole world watching”.

Prosecutors Obviously Believed They NEEDED The Black’s Beach Tapes To Get Convictions

We also opined that The State appears to have put Grant Roy (Sean Lockhart’s partner) on the witness stand (during the Preliminary Hearing) in an attempt to AVOID putting the Black’s Beach Tapes into evidence (and prompting a call by The Defense for Separate Trials), see “Preliminary Hearing Foolishness in Luzerne County”. NOW,

The fact that Investigators did not arrest Harlow Cuadra and Joseph Kerekes until “after they obtained The Black’s Beach Tapes”, strongly suggests that The State did not believe it had enough evidence to convict Cuadra and Kerekes WITHOUT The Black’s Beach Tapes.

It seems apparent that the only “evidence” that physically puts Harlow Cuadra and Joseph Kerekes in Luzerne County at the alleged time of Bryan Kocis death is “The Black’s Beach Tapes”. It apparently was also admitted and/or “made clear” at the preliminary hearing that ALL OF THE ROBBERY CHARGES against Cuadra and Kerekes are based on “The Black’s Beach Tapes” being submitted as evidence (or Grant Roy’s testimony in place of The Black’s Beach Tapes). Clearly, the Defense should jump at the chance to prevent testimony from Grant Roy ABOUT The Black’s Beach Tapes if The Tapes themselves are not admitted into evidence – as was made clear at The Preliminary Hearing.

So, since The State went to the trouble and expense to get The Black’s Beach Tapes in the first place, as we said, isn’t it safe to assume that The State felt very strongly that it NEEDED THE BLACK’s BEACH TAPES to convict Cuadra and Kereks?

Now, if The Black’s Beach Tapes can’t (or won’t) be submitted into evidence because doing so would prompt a call for separate trials, does not this then mean That Luzerne County Prosecutors Do Not Have Faith That They Can Convict Harlow Cuadra and Joseph Kerekes with The Case they presently have? … I’m just saying …

No, Jackie Musto Carroll is not some “Prisoner Hag” writing love letters to Harlow Cuadra hoping that she will be able to snag some Stud Wonder Stud Meat when Harlow is cleared of all of the charges against him.

At least, I don’t THINK Harlow Cuadra and Jackie Musto Carroll are dating. To be perfectly frank, I don’t think Jackie Musto Carroll makes enough money to AFFORD a date with Harlow Cuadra.

Jackie Musto Carrol is the current First Assistant District Attorney for Luzerne County and, she is hoping to be the First Female District Attorney for Luzerne County. Jackie Musto Carroll is running for Luzerne County District Attorney in the coming elections in November.

Isn’t it a TAD strange that the name Jackie Musto Carroll has not surfaced so far in the Bryan Kocis Murder Scandal? I mean, Giuliani rode the prosecution of Leona Helmsley to get elected Mayor of New York City. Why isn’t Jackie Musto Carroll the lead prosecutor against Harlow Cuadra and Joseph Kerekes?

The Current DA for Luzerne County, David W. Lupas, is not going to be District Attorney for Luzerne County when or if the trials for Harlow Cuadra and Joseph Kerekes start. Current DA David W. Lupas is not running to be re-elected District Attorney in November, Lupas is running for Judge of the Court of Common Pleas in November.

Let’s say that on or about January 24, 2007, God was a Closeted Gay Republican and God wanted to fucking blow up the democratically-controlled power structure in the Luzerne County DA’s Office. Do you think God would have driven up to Bryan Kocis’ house, cut Bryan Kocis’ head off, set Bryan Kocis’ ass on fire and then driven away in his Silver SUV yellling: “You Democrats are going Down”?

A gay pornographer/child molester who got off without Registering as a Sex Offender in 2002 (when Democrats were in charge of the DA’s Office) , is so conveniently and so dramatically murdered in time for Bryan Kocis’ “lifestyle in Luzerne County” to blow-up and bring about A Regime Change in Luzerne County. Bryan Kocis’ Murder was:

( a ) just extremely convenient and purely accidential in re the coming elections; or
( b ) it proves not only the existence of God but, it proves that God is a Republican.

Here are a few little facts one can gleem from Jackie Musto Carroll’s announcement for DA:

1. For nearly 15 years, Jackie Musto Carroll worked in one of the smaller offices inside the Luzerne CountyDistrict Attorney’s Office. So, apparently Musto Carroll was employed in the DA’s office in 2002 when Bryan Kocis got probation and non-registration as a sex offender for having sex with a 15 year old boy.

2. District Attorney David W. Lupas, also a Democrat, is finishing his second, four-year term. Hmmm, both Lupas AND Musto Carroll were employed in the District Attorney’s Office in 2002 and they are both Democrats. Isn’t that just special?

3. Musto Carroll was appointed first assistant in 2004. Wasn’t Bryan Kocis gulty plea “corrected” in 2005? Or, was it 2006?

4. Musto Carroll touts a 98 percent conviction rate of criminal cases and a 100 percent conviction rate of homicide cases. Hmmm. So, Why isn’t Musto Carroll all up in Harlow Cuadra’s and Joseph Kerekes’ asses guiding those bad boys to needles?
