Prosecution of Joseph Kerekes and Harlow Cuadra Will Be Halted

Harlow Cuadra has filed an appeal of the order removing Demetrius Fannick as his attorney. PREVIOUSLY, we pointed out that IF the order removing Fannick IS a final and appeal order, then there is no question that the prosecution of Harlow Cuadra and Joseph Kerekes is halted pending appeal. A notice of appeal against a final and appealable order removes jurisdiction of the case from the lower court to the appeal court. However,
Even if the order removing Fannick is NOT a final and appealable order, it is more likely than not that the prosecution of Harlow Cuadra and Joseph Kerekes will be halted.
Why Prosecution of Cuadra and Kerekes Will Be Halted
1. The NUMBER ONE reason the Cuadra Kerekes case will be halted is Joseph Kerekes’ Writ of Habeas Corpus. Once Luzerne County denies Kerekes’ Writ of Habeas Corpus, Kerekes will then be able to petition a FEDERAL JUDGE with a Writ of Habeas Corpus to Federal Court. Luzerne County is not likely to do anything that will have a Federal Judge reviewing whether or not Prosecutors have enough evidence against Kerekes to detain Kerekes.
2. Luzerne County WANTS to delay a trial for Cuadra and Kerekes for as long as possible. THIS FACT should be clear from the fact that Cuadra and Kerekes keep saying they want to GO TO TRIAL. Cuadra and Kerkes keep saying they want to go to trial because they KNOW that Luzerne County doesn’t want a trial. I can’t believe that even Luzerne County is fucking stupid enough to have Bryan Kocis’ Life and Times in Luzerne County exposed for all the world to see via a murder trial.
3. Since Luzerne County will be forced to drop all charges against Harlow Cuadra (as a result of Luzerne County assigning Bryan Kocis’ Lawyers to represent Cuadra), by halting the prosecution of Cuadra and Kerekes pending appeal, Luzerne County will be able to keep Cuadra in jail for possibly another year, before Luzerne County is then forced to drop all charges against Cuadra.
