Appeal by Harlow Cuadra HALTS Prosecution of Joseph Kerekes

The news out of Silly Ass County (aka Luzerne County) is that Harlow Cuadra has filed an appeal of the order removing Demetrius Fannick as Cuadra’s lawyer. Don’t you think that this additional delay in all charges being dropped against Cuadra and Kerekes is exactly what Silly Ass County was hoping for?
WILKES-BARRE – Homicide suspect Harlow Cuadra has appealed a judge’s ruling that forbids attorney Demetrius Fannick from representing him … Cuadra filed notice Thursday that he will appeal Luzerne County Court of Common Pleas Judge Peter Paul Olszewski Jr.’s ruling to the state Superior Court. There are two very important legal points associated with Harlow Cuadra filing a notice of appeal:
1. A timely filed appeal of a final appealable order DIVESTs the Luzerne County Court of Common Pleas of jurisdiction over Harlow Cuadra’s case. If the decision removing Fannick as Cuadra’s lawyer was a final and appealable order, then, the filing of a notice of appeal by Cuadra means that The Luzerne County Court of Common Pleas no longer has jurisdiction to do anything whatsoever over Harlow Cuadra’s case until The Supreme Court decides Cuadra’s appeal and returns jurisdiction of the case back to Luzerne County Court of Common Pleas.
2. Since the prosecutions of Harlow Cuadra and Joseph Kerekes were NOT separated prior to the appeal filed by Cuadra, The Luzerne County Court of Common Pleas no longer has jurisdiction over Joseph Kerekes either until Cuadra’s appeal is decided. IF Cuadra’s appeal was a timely filed appeal of a final and appealable order, THEN, the prosecutions of Harlow Cuadra AND Joseph Kerekes is HALTED until jurisdiction of the case is returned to Luzerne County Court of Common Pleas AFTER the Supreme Court decides Cuadra’s appeal.
I think it was less than 24 hours ago that we posted a message saying that there was no way in hell there was going to be any murder trial for Harlow Cuadra in September 2008. Since the prosecution of Harlow Cuadra is dead anyway, the order removing Fannick seems to have just been a way to keep Cuadra in jail a few more months longer than necessary.
No fucking court anywhere in America is going to hold that it was “just Hunkydory” for Cuadra to be assigned the murder victim’s lawyers. All Luzerne County can hope for with respect to Cuadra is to delay the time that they are FORCED to drop all charges against Cuadra.
The Good News
The good news about an indefinite HALT to the prosecution of Harlow Cuadra and Joseph Kerekes by The Luzerne County Court of Common Pleas means that some delusional fahkers focused soley on the intimate details of Harlow Cuadra’s life and finances might actually have to get a fucking life for the next year or so!
