Neither Luzerne County’s Times Leader newspaper nor The Citizens Voice newspaper appear to have any CLUE that The Commonwealth of Pennsylvania has law stating that extradited persons are immune to the service of civil process WHILE those persons are awaiting trial on the criminal offenses for which they were extradited.

Kruezeratnight knows about the Commonwealth of Pennsylvania’s law granting immunity from service of civil process to extradited person, why doesn’t The Times Leader and The Citizens Voice have a clue?

If I can spend an afternoon doing legal research on the net and come up with a shit load of case law and the cite for the actual Commonwealth of Pennsylvania statute holding that Harlow Cuadra and Joseph Kerekes as extradited persons are immune to the service of civil process, how is it that Luzerne County’s major news outlets didn’t report this INTERESTING FACT before me?

How ROGUE Is Luzerne County?

The Commonwealth of Pennsylvania statute holding that extradited persons are immune from the service of civil process seems very clear. However, it was also very clear that attorney Al Flora, Jr was Bryan Kocis’ lawyer when Flora was assigned to represent the accused Harlow Cuadra.

If Bryan Kocis’ estate is allowed to serve civil process on extradited persons Harlow Cuadra and Joseph Kerekes before the conclusion of the criminal proceedings they are facing, we will all have a clear-er idea of just how Rogue Luzerne County has become.

BTW, you don’t do this kind of shit to two guys you have an ironclad case against. You don’t jeapodize an ironclad murder case by assigning the victim’s lawyer to represent the accused. You don’t jeapodize an ironclad murder case by seizing the assets of the accuseds so that they can’t afford legal counsel. You don’t jeapodize an ironclad murder case by allowing someone to proceed with a civil suit against the accuseds when they are suppose to be immune from the service of civil process.

Jackie Musto-Carroll is the Wild Card in Luzerne County

It seems clear to me that New DA Jackie Musto-Carroll is not about to begin her political career by covering herself in the kind of bullshit which seems standard business practices in Luzerne County.

Musto-Carroll appeared to have threatened to drop criminal charges against Cuadra if the Public Defender was not removed as Cuadra’s Lawyer. Let’s hope Musto-Carroll will drop all charges against Cuadra and Kerekes if Bryan Kocis’ estate is allowed to serve Cuadra and Kerkes with a civil suit WHILE they are facing criminal prosecution as extradited persons?
